Marketing terms of service

This is the contract you accept when you pay for your plan. Take your time: it is written to be understood.

1. The parties

The provider: Giovanni Guadalupe, trading as Kaleidoscopio Digital, Ecuadorian tax ID (RUC) 1721791257001, based in Quito, Ecuador. Email: giovanni@kaleidoscopiodigital.com · WhatsApp: +593 96 401 6145.

The client: the person or company that pays for the plan, with the details entered in the form on the website.

I work remotely, from Ecuador, for clients in any country.

2. How this contract is accepted

By ticking the box “I accept the service contract” and paying, you accept this contract. It has the same validity as one signed on paper, under Ecuador’s Law on Electronic Commerce, Electronic Signatures and Data Messages.

I keep a record of the date, the plan, the amount and the version of these terms you accepted. You can print this page or save it as a PDF at any time.

3. What the service includes

The services in the plan you built on the website, at the price shown in it. If you later want something that is not in your plan, I quote it separately and we only do it if you agree.

For the Web platform, the price in the plan builder is the starting price. If your project needs more, I send you the final price in writing before starting and you pay the difference only if you agree; if you do not, I do not start and I refund what you paid.

4. Price and payment

• Prices are in US dollars. If your WhatsApp number is from Spain or elsewhere in Europe, you pay the same amounts in euros.
• One-time payment up to $200: you pay 100% upfront.
• One-time payment over $200: you pay 50% upfront and the remaining 50% before launch.
• Monthly plans: paid in advance, at the start of each month.
• You pay by PayPal (card or PayPal account) or by bank transfer.

5. What you pay separately, in your name

My prices are for my work. You pay these costs directly to each provider, in your name and with no markup:

• Domain and hosting.
• Server (VPS) for the AI chatbot.
• AI usage (API), paid per message.
• WhatsApp Business Platform, which Meta charges per conversation.
• Advertising on Meta or Google: you decide how much.

I help you choose the domain and hosting and set them up at no extra cost.

6. How we work and timelines

The work follows the stages explained on the Marketing page: your idea, wireframe, design, beta version, revisions, testing and launch. Each stage’s timeline is approximate and starts once I have your idea, your texts and your photos. When a stage needs your approval, the clock resumes when you reply.

7. What you provide

• Your idea, texts, photos and logo, within 15 days of payment. If I do not receive them within 15 days, the project is paused and resumes when I have them.
• Timely replies when I ask you to review or approve something.
• Your own material, or material you have permission to use: whatever you give me for your website must be yours or licensed to you.

8. Revisions and changes

2 rounds of revisions are included. In each round, send me all your comments together. Each change outside what was agreed, and each change after launch, costs $50: a text, a photo, a price or a new section.

9. Who owns what

• The domain and hosting are yours from day one, because they are registered in your name.
• The website, design and texts I create for you become yours once payment is complete.
• I may show your project in my portfolio. If you would rather I did not, tell me and I will not.

10. Monthly plans and cancellation

They run month to month with no minimum term. To cancel, give me 15 days’ notice; there is no penalty. A month already paid is not refunded, but I complete the work for it.

11. Refunds

If I cannot take on your project, I refund everything you paid. Once work has started, there are no refunds.

If you are a consumer (not a business) living in the European Union, you have 14 days to withdraw. By paying, you ask me to start immediately: if you withdraw before I finish, you pay only for the part already done, and once the service is complete you can no longer withdraw.

12. What I cannot guarantee

I put all my work and experience into your project, but some results do not depend on me alone: how much you sell, where you rank on Google or in AI tools, or whether Meta approves your ads. I am also not responsible for outages, failures or price changes of external providers (hosting, Meta, WhatsApp, PayPal). If something goes wrong through my fault, my liability is limited to what you paid me for that service.

13. Your data

I use your data only to do your project, as explained in the privacy notice.

14. Changes to these terms

If I update these terms, I publish the new version with its date. Your project continues under the version you accepted when you paid.

15. Governing law and disputes

This contract is governed by the laws of Ecuador. If a problem arises, we first talk it through to reach an agreement; if we cannot, it is settled by the courts of Quito. If you are a consumer in another country, you keep the rights your country’s law gives you that cannot be waived.

This contract is translated into English for your convenience; if there is any difference between languages, the Spanish version prevails.
